Please read these Terms and Conditions carefully before using and registering your car with PAMDRIVE

Your access to and use of the Pamdrive service is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users and others who access or use the service. By accessing or using the service you agree to be bound by these terms. If you disagree with any part of the terms or not willing to be associated to it, then you may not access the Service.

The terms of use stated herein constitute a legal agreement between you and Pamdrive Services Limited. By using this website www.pamdrive.com and downloading, installing or using any associated software supplied by Pamdrive, whose overall purpose is to enable persons seeking transportation services to certain destinations to be matched with third party transportation providers, you hereby expressly acknowledge and agree to be bound by the terms of use, and any future amendments and additions to this Terms of use as published from time to time.

This terms and conditions convers for every city, states, provinces, countries, and continent where Pamdrive services is found, except otherwise stated and or where it conflicts with the government rules and regulation. Pamdrive Services Ltd shall abide and respect local laws, it shall format it services to correspond and to meet local and government requirements of the countries, provided that such laws are favorable to Pamdrive Services Limited and it existent in that country or place.

 

Definitions

Pamdrive Services limited – Pamdrive services limited is a “proudly Nigerian” on-demand & e-hailing company founded on May 1, 2016 first in Port Harcourt, Rivers State, Nigeria. (Company Reg. No.:  RC1317152).

Pamdrive app - an application for internet-enabled portable devices (“Smartphones”) via which users can access and order taxi services in various locations.

User – anyone (driver, passenger, partner) using Pamdrive services.

Passenger - a person using the Pamdrive app for requesting transportation services.

Driver - registered and trained transportation services provider whose service can be requested through the Pamdrive app.

Partner – a person who registered his/her car on Pamdrive to access and hire a driver from the Pamdrive drivers pool.

Fare - the fee user is obliged to pay to driver for the provision of ride services.

Services - the transportation service rendered to passengers by the driver.

Agreement - Users acceptance and compliance with the terms and conditions of service between Users and Pamdrive services limited

 

What We Do

The Pamdrive website is a specialize service with the purpose to optimize the taxi request service, however without creating any employee relationship with the taxi drivers.

This means that Pamdrive should be considered only as a service provider with the purpose of scheduling through the system.

Pamdrive allows, totally free of charge, the passengers to sign up and locate the nearest driver to request their services in a more efficient way than the conventional existing methods.

Pamdrive is not a transportation company but a taxi booking platform that connects drivers and passengers using the available service options like app, phone lines, SMS systems etc.

The driver, by his/her means, can register via the website, app or through Pamdrive servicing office, pending an evaluation from Pamdrive, the drivers are trained and approve to render transportation services.

Drivers who desire to drive with Pamdrive but don’t have their own can also register via the website to join a pool of drivers waiting to be connected and hire by a partner who desire to enlist their car on the Pamdrive system.

Pamdrive allows registration from individuals with cars who desire to enlist their car on the system but don’t want to drive. They are given access to connect and hire from the Pamdrive pool of drivers without their own cars.

 

Registration And Use Of The System

When registering, the user agrees to provide accurate information, complete and updated as requested on the form.

Only those individuals who have full legal capacity (age wise) are allowed to register and use the Pamdrive app.

The driver agrees that by registering, will be evaluated before being approved by Pamdrive who reserves the right to refuse or cancel his user account at any time based on complaints from passenger or by internal policy.

The Pamdrive services further reserves the right to use all legal means possible and to identify its users, as well as to request, at any time, additional data and documents it considers appropriate in order to verify personal data informed by the user.

Users may not transfer in any way, the user’s registration to a third party. Pamdrive is not liable for any damage resulting from the disclosure of the password to third parties. You shall be solely responsible for this.

 

Passengers Use Of The System

Only registered passengers may use Pamdrive to call for ride. By registering to use the service, you agree to:

Provide truthful and up to date information during the registration process, and shall only use the service in good faith, without breaking any laws in the country where the ride is requested.

Never abuse the service by requesting a ride without the intention of using it. If a problem arises during the use of the service, passenger shall, in good faith, attempt to solve the problem with the help of the transport provider (driver) and Pamdrive customer service.

Never use the service in a way that causes damage to Pamdrive.

Drivers will not accept any or render services to any passenger with an unknown address that is not defined in our Pamdrive Access Point location.

Pamdrive will not accept to render any services to any Passenger who is carrying any harmful or Hazardous device that is not well defined.

Passenger must not smoke inside the vehicle, else may be liable to pay a valeting charge.

Passenger must adhere to the agreed registered pickup time with Pamdrive. Any attempt to change the booked pickup time without the knowledge of Pamdrive service will not be accepted.

If for any reason, you desire to cancel your ride request after six (6) minutes, you agree to pay any penalties fees and costs incurred by PAMDRIVE resulting from your ride cancellation.

 

Limitation Of Liability

Users accept that Pamdrive acts solely as a scheduling/matching service between its users and drivers, and that it is not responsible for any issues that arise during the ride, such as accidents, delays, or car discomfort, however, will try to avoid any of these cases and create comfort for passengers.

Pamdrive, on the other hand, commits to provide a thorough screening service so that only drivers in good, legal standing in their cities/countries shall take part on the service.

 

Driver - Passenger Relationship:

Pamdrive does not provide transportation services by taxi; it serves only as an intermediary in order to optimize the scheduling service for the transport provider. Thus, by accepting the provision of services by the driver, the passenger acknowledges that he/she will verify the driver details to correspond with the details provided from the app, SMS systems, phone lines and any other communication feedback platform.

The passenger also acknowledges and agrees that, by registering and accepting the policy of the service agrees to provide all required details and data requested.

 

From Availability and Inconsistency In The System

Pamdrive does not guarantee that the system will be available without any interruption and that it will always be error-free, and therefore, shall not be liable for damages caused to users.

You agree that Pamdrive is also not responsible for any damages or losses caused to your device as a result of using the website or app.

Pamdrive is not liable for any error or inconsistency of information with other independent systems, specializing in the service provision for GPS, radar and similar.

 

Compensation For Damages:

User agrees to indemnify and hold harmless Pamdrive and its representatives from any claims, suits, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees and court costs for the damage they cause.

 

Evaluation Of Drivers

It is a choice for the passenger to evaluate the drivers who transported them, rating or giving feedbacks on their service. passengers can evaluate their drivers anonymously. Evaluations shall be for the exclusive use of Pamdrive in order to better serve the passenger and may even block the driver in case of several complaints. Pamdrive reserves the right to use the evaluations to improve the service, whether for internal or external usage.

 

Sanctions

Pamdrive may notify, suspend, or terminate, temporarily or permanently, the account of any user at any time, and take legal actions if:

(I)        He/she violates any of the representations, warranties and obligations contained in these terms of use, any policies, or rules and adjacent to it.

(II)       He/she is deceptive or involved in fraudulent practices.

(III)     Pamdrive concludes, in its sole discretion, that the activities and attitudes have caused or may cause harm to others or Pamdrive. The user shall not be entitled to any indemnity or compensation for the cancellation or suspension of the users’ account on the system.

 

License

Pamdrive grants to the user a limited, personal, nonexclusive, non-transferable, non-commercial and fully revocable license to use the website/application on his/her mobile or computer, in conformance and agreement of the terms contained in this agreement. Pamdrive reserves all rights to the website not expressly granted here.

Pamdrive is not liable for any damage suffered by the user who has copied, transferred, distributed, or used any website protected content, violating the rights of others.

 

General Conditions

These term of use does not generate any partnership agreement, in office, franchise or employment relationship between the user and Pamdrive.

These terms of use may be changed by Pamdrive anytime. The changes will come into force automatically on the date of the publication of the new version on the website.

These terms of use shall be governed by and interpreted in accordance with the laws of each country and any disputes arising from this disclaimer which cannot be resolved by the parties, shall be submitted to the jurisdiction of the each determined city.

By registering as a driver, passenger, customer or partners in the system and electronically accepting this term, by clicking the “I accept the terms of use”, the user declares automatically and unconditionally to comply with these terms and all other policies and rules available in the system.

 

Payment And The In-App Payment Function

Payment shall be made during booking or after arriving at destination. It is expected that the passenger pays per distances covered in kilometre and also per one (1) minute.

Passengers understand and agree that payment must be provided to the driver regardless of any malfunction of the mobile application. In particular, when using the in-app payment functionality, or Pamdrive Pay. Passengers accept that there might be circumstances beyond Pamdrive control that might cause a credit card to be rejected, and that, in such circumstances, the user must reach an alternative payment method with the driver.

 

Intellectual Property

Use of the service does not transmit any intellectual property rights between Pamdrive and its users. Users agree not to steal and/or publish, without Pamdrive explicit consent, any material, screens or artwork presented by the application during the use of the service.

 

Termination

Pamdrive reserves the right to block any user on its platform should it suspect said user is attempting to abuse the platform or mislead drivers, Pamdrive employees, partners, or other users through the platform. These actions include but are not limited to using stolen credit cards, requesting ride without the intention to board them, not paying for the service and constantly cancelling requests before the taxi arrives.

Any cancellation of bookings will be surcharged. Job cancellation terms are specified on the Pamdrive website, and all registered users must adhere to the Pamdrive terms and condition of use.

 

 

PRIVACY POLICY

Personal Data, Information and Your Rights

PAMDRIVE SERVICES LIMITED takes personal and private data supplied by users very seriously. Users’ personal data will not be sold to another party i.e. website, advertiser or other third party without the users’ permission.

Above permission is used for access location after allowing the user for accurate delivery of the product to door of customer. Location service is used under the privacy policy of Google Play Developer Program Policies. We don’t share any type of location data or customer information for any additional resources. we ensure to the customer for safe and accurate delivery with privacy taking under an authorization is appropriately secure and under the law of google consents.

ACCESS_BACKGROUND_LOCATION

Above the location background, permission is used for Delivery/service (for example, food, package) tracking on the user side. Location service is used under the privacy policy of Google Play Developer Program Policies. We don’t share any type of location data or customer information for any additional resources taking under an authorization is appropriately secure and under the law of google consents.

We welcome your comments regarding this privacy statement at the contact address given at the App. Should there be any concerns about contravention of this Privacy Policy, we will employ all commercially reasonable efforts to address the same. The terms in this Policy may be changed by us at any time. Should you have concerns regarding this Policy or the Services that we offer, please feel free to write to us.

IN WITNESS WHEREOF, all users or visitors of the App agree that they have read the terms mentioned in this Privacy Policy and agree to be bound by them for as long as they continue to either use the App or avail Services of the Company.

The Data We Process

The prerequisite for using the Pamdrive app involves the users’ agreement to the processing of personal data such name, address, phone numbers, email address, payment information, device information, profile photo (if provided), Information about disputes. As for drivers and partners, besides the previously mentioned, the registration number and grantee or auxiliary data of vehicle, such as make, model, colour, and plate, among others.

Pamdrive collect and process users’ personal data in the course of installation and use of the Pamdrive app.

 

What We Do with The Data We Collect

Any personal data collected in the course of providing our services is stored in the Pamdrive data base for the purpose of improving our services in order to provide users with a better and a more robust service as contracted with you. The data is used in unidentified form.

Pamdrive may periodically send promotional emails, messages, and any information about new products, special offers or other information that users may find interesting via email address and contact numbers which users and Provider have provided, also, Information and communcaiton can also be done via customer or Provider mobile application

However, if users no longer wish to receive direct marketing messages from Pamdrive, users can easily click on the unsubscribe link in the footer of our e-mail. If users encounter any challenge with this, users can contact Pamdrive via the chat support on the Pamdrive app.

Legal Basis

Pamdrive is committed to ensuring that its users’ information is secured. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

However, users’ personal data may be processed on legitimate interest grounds, e.g. investigating and detecting fraudulent payments.

Pamdrive shall not be liable for any loss of users’ data, including resulting from acts of God, force that occurred because of the invasions to the website and security breach by unauthorized third parties.

 

Drivers’ access to data

Your data such as name, Phone number and geolocation will be disclosed to our drivers for the purpose of completing your request and resolving any issues relating with the service provision such as contacting you if something was left behind in the vehicle during your ride with Pamdrive Services.

Be assured that this will be done within the privacy laws and regulations that apply and will require the driver to protect the information they receive and use it only for the purposes for which it was provided.

 

Data access and correction

If you believe that any of your personal data, we are holding on you is incorrect or incomplete, you can access and update your personal data via the Pamdrive app.

 

Data deletion

Please note that the deinstallation of the Pamdrive app in your device does not cause the deletion of your personal data.

Any of your personal data can be deleted upon your request within a month notice. Simply submit your request by e-mail stating the specific period of data that should be deleted.

You should bear in mind that you will not be able to use the Pamdrive app via an account which has been deleted.

 

 

PARTNER

Pamdrive does not in any way guarantee for any driver you hire from our pool of drivers. We advise that you thoroughly evaluate the driver you intend to hire from our pool, and if you so desire, you can develop terms of contract agreement to be signed by you and the driver.

By Hiring a driver from our pool, you agree that Pamdrive acts solely as a matching service between car owners and drivers, and that it is not responsible for any issues that may arise during the transaction such as stolen vehicle, mismanagement of vehicle, accident, or driver failure to make remittance.

However, we commit to painstakingly screen and verify our drivers so that only trustworthy drivers of good report and legal standing in their cities shall take part on the service.

By completing and submitting this form, you expressly certify that you want to put your car on the Pamdrive platform and that you are requesting Pamdrive to give you access to hire someone from her pool of drivers to drive the vehicle. This also signify that you have read, fully understand, and agreed to the terms and conditions as stated by Pamdrive.

Hiring a driver from our pool for purpose other than driving on the Pamdrive platform is considered fraudulent.
